Article 1: Preliminary provisions

These General Terms and Conditions of Sale (hereinafter the “Terms and Conditions”) apply in their entirety as of January 1st 2022, to all activities and services organized within the Omega Park (hereinafter the “Services”) and sold to individual customers (hereinafter the Customers) by Parc Omega INC. (hereinafter the “Seller”).

The Terms and Conditions govern all sales of services carried out by telephone at the contact centre, at the Parc Oméga counter, at the seller’s accommodation reception or online at the Parc Oméga website www.parcomega.ca (the “website”).

The Seller offers to Customers, (i) hotel services in the form of stays or overnight stays (ii) the services of visiting the animal park in the form of ticketing (electronic ticket, annual subscription, gift certificate, combined ticket) and (iii) any other ancillary service (restoration, etc.).

As part of the GTC: the “stay” means a tourist package, consisting of at least one night in one of the seller’s accommodation, a breakfast and a visit to the Omega Park; the “accommodation” means a single night in one of the seller’s accommodation, the “ticketing” or “ticket” means an access ticket, daily ticket, package or subscription allowing the customer to access the leisure areas of the Parc Oméga on a specific date or for a specified period of time; any purchase of any of the aforementioned services implies on the part of the customer an unconditional acceptance of the GTC, notwithstanding any stipulation to the contrary.

Article 2: identification of the seller

The services of the present are organized and sold to customers by: Parc Omega INC.

Article 3: order of services

The purchase of the services (hereinafter the “order”) is made:

  • At the Seller’s counter, 399 Route 323 Nord, Montebello, Quebec J0V 1L0, on the opening days of the Omega Park, and at the reception of accommodation;
  • By phone at the contact centre at 819-423-5487 (toll-free call – cost of local communication);
  • Online at parcomega.ca

Article 3.1: pre-contractual information

It is specified that the information appearing on the website and booking summary, supplemented by these terms and conditions, constitute the prior information. Therefore, the customer acknowledges having received the communication, prior to the confirmation of the reservation and the conclusion of the contract, in a clear and understandable way, the pre-contractual information and in particular the following information:

  • The destination, the essential characteristics, the tourist category of the accommodation;
  • The total price of the trip and the terms of settlement;
  • The conditions of cancellation;
  • Services and meals included in the activity price;

For any purchase of services other than stays, the customer acknowledges having received the communication prior to the confirmation of the reservation and the conclusion of the contract, in a clear and understandable way, pre-contractual information including:

  • The description and essential characteristics of the service;
  • Price and date of execution.

Article 3.2: Telephone order

For any telephone order, the customer must specify, in addition to the mandatory information mentioned above, the mailing address (postal or e-mail) and the name of the beneficiary.

The seller after having communicated to the customer the pre-contractual information listed in article 3.1 of these terms and conditions, invites him to consult these terms and conditions. Once agreement has been obtained on the fulfilment of the order under the conditions communicated, the customer proceeds to the remote payment according to the modalities provided in article 5.

Article 3.3: online ordering

For any online order, the customer is asked to fill in their email address and, if necessary, to identify themselves using a personal customer account creation form. The customer has the possibility to check the details of his order and its total price, and if necessary to correct the errors before confirming it by expressing his acceptance. To finalize the order, the customer must read the terms and conditions, accept them by ticking the boxes provided for this purpose and proceed with the payment.

Article 3.4: order confirmation

The order is firm and final only when the entire price has been cashed by the seller. The sales contract is then deemed formed. For any order for services online or remotely, the customer receives, by email, a confirmation of the order summarizing the purchases made, the price applied and the essential characteristics of the ordered services. For all Ticket orders, the confirmation email includes:

  • The proof of payment;
  • The dematerialized access title(s).

For any stay or accommodation order, the confirmation email includes:

  • The proof of payment;
  • The description of the services ordered.

The confirmation email of the order received by the customer constitutes proof of the entire transaction and is the only authentic document in case of dispute.

Article 4: price of services

Prices for our products are quoted in Canadian dollars and applicable taxes are added. All orders, regardless of origin, are payable in Canadian dollars. The seller reserves the right to change his prices at any time. The products are always invoiced on the basis of the prices in force at the time of the order registration.

The seller reserves the right to reduce its rates and apply discounts at any time, without being obliged to refund customers who have bought tickets at the regular price.

The seller reserves the right, without further notice, to refuse to do business with a customer or to set a quantity limit for any item in an order. At any time, it may be necessary for the seller to verify personal or credit card information before accepting any order.

The seller is subject to Canadian sales taxes. The taxes added will be T.V.Q. (Quebec Sales Tax) and T.P.S. (Goods and Services Taxes).

Article 5: terms and means of payment

For any order for services, the full price must be paid in Canadian dollars at the time the order is placed. Payment can be made by credit card, Mastercard or Visa. The proposed fees must be paid according to the payment procedure described during the registration process. The Customer agrees to pay the total cost and charges of the purchased product, including taxes. The seller may change the price after notifying the customer. The customer is solely responsible for the actual payment of the purchased product. Only the user is responsible for paying by credit card for the service offered. The seller is not responsible for payment problems related to the operation of the e-commerce service.

Electronic payments made as part of orders by phone or online on the seller’s website are secured by the use of the encryption process guaranteeing the confidentiality and security of the data.

Article 6: delivery of tickets and terms

For any remote order, the access tickets are sent to the customer by email immediately after payment of the order.

Day tickets

Non-refundable product. The customer confirms that he has read and understood the security instructions and any other special measures put in place by the seller (see Articles 9 and 11).

Omega Night or Night Event Tickets

Non refundable and non modifiable product (date and time).

Rain or shine, the event takes place. In the event of adverse weather conditions (high winds or thunderstorms), the seller may delay departures or cancel the activity to ensure everyone’s safety. In the event of a cancellation, the information will be posted the same day as of 3:00 p.m. on parcomega.ca, as well as on the Park’s Facebook page. For any cancellation made by the seller, ticket holders will be able to select a new date and time slot.

Booking required for toddlers (2-5 years old). Children 12 and under must be accompanied by an adult at all times. It is strictly prohibited to use drugs and alcohol during this activity.

By acquiring the ticket, the customer acknowledges that he is travelling on the trail at his own risk. The course is accessible to people with reduced mobility. However, it has ascending and descending slopes of about 35 degrees. By acquiring the ticket, the customer acknowledges that he is able to undertake the activity with full knowledge of the facts and accepts the risks that this activity may entail. The customer agrees to comply with all safety rules and other rules imposed by the seller.

Gift certificate

This product is non-refundable and not marketable. Resale is strictly prohibited and illegal. The amount of the gift card can be used on the purchase of entrance fees, on the catering and in the various points of sale of the Omega Park. This gift certificate is not valid for online booking and payment. It is not replaceable or refundable in case of loss, theft or damage.

Annual subscription

This product is non-refundable and not exchangeable.

The subscription issued by the seller allows holders to have access to the animal park at all times during the opening hours in force (opening hours vary according to the seasons).

The subscription is valid for one year. The period covered by the subscription begins on the date of purchase. Once the purchase is made, the individual must go to the Omega Park to take his photo and collect his card before his first visit.

The subscription may only be used by its holder and may not, at any time, be sold, transferred or exchanged.

The holder’s photo must appear on the subscription card.

Holders of subscriptions under the age of 16 must be accompanied by an adult to have access to the park.

To benefit from access to the park, the holder must present his subscription card upon admission. An identity card may be requested at any time from the holder of the subscription.

In the event of card breakage or loss, a new card can be requested from the administrative office for a fee of $5.

The seller reserves the right to temporarily close the park or certain sections of the park due to extreme weather conditions or other exceptional conditions.

The seller reserves the right to close parts of the park without notice.

A subscription card can be withdrawn at any time by the seller if the customer’s behaviour does not comply with the safety instructions on the Parc Omega site. No refund or compensation will be granted in such a situation.

Article 7: control of tickets

A dated ticket is valid only for the date(s) it mentions. An undated ticket does not guarantee access to the park in case of heavy traffic. Tickets are checked at the entrance to the Parc Oméga using bar code readers or QR code. In this context, the seller reserves the right to check the identity of the customers carrying the notes.

The paperless ticket (E-ticket) is only valid if it is printed on white paper, blank front and back or if it is displayed on a mobile phone screen of type «Smartphone».

The customer remains solely responsible for the use made of his or her tickets. A damaged, illegible or already read (thermal or paperless) ticket is considered invalid.

Article 8: description of products

Article 9: general safety rules

The customer confirms that they have read and understood the safety instructions and any other special measures put in place. To visit the park, it is imperative to have a vehicle (car, bus, recreational vehicle). Motorcycles are not permitted on site. Pets are strictly prohibited in the park and in the accommodations of Omega Park. It prohibits getting out of the vehicle. All vehicle doors must be closed (tailgate and sliding doors). During the drive, the windows must be half up to prevent animals from entering the customer’s vehicle. It is forbidden to feed bison. During the breeding season (September to mid-November), avoid approaching male cervids. It is strictly forbidden to feed them. You travel at your own risk and in case of non-compliance with its general safety rules, the seller’s liability cannot be incurred, and the seller reserves the right to exclude, without any refund being possible, customers not complying with these general safety rules.

Article 10: Recommendations

  • Bring photo identification and the credit card used to purchase the ticket.
  • Protect your ticket like any other valuable item.
  • Never purchase an e-ticket from a stranger. This may be an unauthorized copy. The e-ticket has no resale value.

Article 11: Liability

The holder of an electronic ticket assumes all responsibility for the risks and dangers that may arise from the activity that they are subjected to before, during or after it and waives all claims for loss and damage resulting from any cause whatsoever. The seller cannot be held responsible for any direct or indirect problems or damages that may arise during the event.

The electronic ticket, annual subscription or gift certificate is a contract between the customer and the seller. Buyer agrees to pay the amount indicated on the receipt, including service charges if applicable. The amount billed will appear on the next statement of account as PARC OMÉGA INC. No refund or exchange will be granted unless the event is cancelled by the seller. In such a case, the purchaser must contact the event sponsor or the administration of PARC OMÉGA INC. at (819) 423-5487.

Article 12: exceptional and unavoidable circumstances

Exceptional and unavoidable circumstances means any situation beyond the control of the customer, the seller and any service provider involved in the execution of the order, The consequences of which could not have been avoided even if all reasonable steps had been taken to prevent the fulfilment of all or part of the obligations under the contract.

This will be the case in particular in the case of: major force, climatic, geographical, health or political conditions in the immediate vicinity of the destination likely to endanger the life of the client. In the event of the occurrence of exceptional and unavoidable circumstances, the right to cancel the contract at no cost is possible for both the seller and the customer. It is specified that the assessment of the occurrence of these circumstances will be based solely on objective elements.
