Parc Omega Inc. is committed to respecting the privacy of its customers and guests (“you” and “your”). The Parc Omega Inc. Privacy Policy (the “Policy”) applies to personal information that Parc Omega Inc collects online, in person, through its call centres or otherwise.

“Personal Information” is information associated with an identifiable individual or household. Personal Information does not include information about a company or anonymous aggregated information that cannot be associated with a particular individual.

This Policy does not apply to information relating to Parc Omega Inc employees or information other than personal information.

THE PERSONAL INFORMATION WE COLLECT AND HOW IT IS USED

Parc Omega Inc collects Personal Information as part of its activities as a tourism complex. We use this information to provide you with the best possible quality of service and to meet reasonable business needs.

>(a) We collect your Personal Information when you purchase a ticket or when you book accommodation.

When you purchase a product or service, make a reservation, or register for a program, we collect Personal Information to complete the transaction and administer the purchase or program. We may also send you information about your purchase, booking or program. For example, if you make a reservation at one of our centres, we may send you information about the activities, events or offers taking place at the resort during your visit. The information we may collect and use for these purposes includes, but is not limited to:

  • Your name and contact information to identify and communicate with you.
  • Your payment card information to process transactions related to the purchase of park access tickets or accommodation reservations.
  • Your age and/or date of birth to ensure appropriate product pricing and to learn more about who benefits from our products and services
  • Your gender to verify your identity, provide appropriate services, such as equipment rentals, and learn more about the people who benefit from our products and services
  • Your medical information, such as allergies or a health condition that we need to know if you have dietary restrictions
  • Your status as a parent or guardian of a minor guest, if applicable.
  • Experience preferences (such as the type of room you prefer)
  • Your geographical location in order to locate the participants of the ski school or other guests who have chosen to use the mountain tracking technology, including our applications that offer this tracking, during their stay on our mountains;
  • Your transaction history to manage your purchases and bookings and to learn more about how you interact with our products.
  • In some cases, you may provide us with Personal Information about a family member or other individual. When you provide us with Personal Information about an individual other than yourself, you represent that you have the consent of that individual to disclose their Personal Information for the purposes described in this Policy.

> (b) We collect your Personal Information when you visit our park, book accommodation, use our tickets, and download and use our web and mobile applications (the “Apps”).

When you purchase or use our Omega Park tickets, we may collect information about your geographic location, activities and purchases while you are at Omega Park. Our tickets use hand scanner technology. By using this technology, we may be able to collect limited information about your location in the centre and, if a payment card is associated with your ticket, other commercial transactions that you perform in one of our stores, accommodation, or restaurants. We use this information to understand how our guests use our centres and your personal preferences.

Depending on your marketing preferences, we may also use your Personal Information to send you offers, invitations and promotions related to our centres, products, services or programs that, we think you might be interested. For example, we may monitor your business transactions or browsing habits on our websites or centres, which may determine the types of special offers and personalized promotions we send you.

In addition, if you book accommodations, this privacy policy will apply to this transaction.

We also have an App that can be downloaded to your mobile device. Downloading, installing and using our App will give you convenient access to the wonderful experiences offered by our Nature Park, including the possibility to purchase tickets and book accommodation, to track and share your performance, create a profile, and receive notifications in the application (collectively, the “Application Services”). If you access our application, we may be able to collect your Personal Information, including your geographic location, activities, and purchase history. We may also associate the information collected because of your use of the Application with your customer profile, including your ticket and/or accommodation data.

The Apps automatically collect detailed location and navigation information in the form of GPS signals from the mobile device on which you have installed and activated the App (“App Location Information”). When you open, use or interact with the Application Services, we use the Application Location Information (e.g., latitude and longitude) to customize the Application Services experience based on your current location. We also use your Application Location Information to provide you with certain Application Services, including to send you notifications of other relevant information. If the “Background Locator” feature is enabled, the Applications may, from time to time, tell us the location of your device, even if you do not interact directly with the Application. We may use various technologies to determine your App Location Information, such as the location services of the operating system in question, GPS, Bluetooth, i-Beacon, RFID and data from the sensor of your devices, in addition to nearby Wi-Fi hotspots and cell towers, and other technologies to determine the approximate location of your mobile devices.

If you do not want the Applications to track your Location Information, you must disable the Application Location Information tracking feature in the Application settings menu. If you disable the Application’s Location Information feature, some of the features of the Application and the Application Services may not be provided without the use of this standard technology.

We store and save archives of such data on servers to provide these functions, and protect our rights and property with respect to our Application Services, and you acknowledge and agree to the backup of such data.

It is possible that some of our resorts use video surveillance systems to ensure the safety of our guests, employees, and our facility. We will keep the video recordings for as long as is reasonably necessary for those purposes.

> (c) We collect your personal information when you submit a request for information, complete a guest survey or provide feedback

We may collect your name, contact information, comments, or questions when you submit a request or comment, or otherwise provide us with feedback on our business. We may also collect information about your experience in one of our mountain destinations or the use of our products or services as part of a customer satisfaction survey. These surveys may include optional questions about your income, or your gender that, if answered, help us learn more about our customers and how we can improve our business and public engagement in snow sports. We may use this information to answer your question and to improve our business, products, services and programs.

> (d) We collect your personal information when you participate in a marketing initiative or create an online account

If you choose to create an online profile, we may collect your name, contact information, age, gender, date of birth, personal image, username and password, and any other information you choose to reveal to us (such as your preferences).

We may also collect your name, contact information and age or date of birth if you decide to participate in a marketing initiative such as a contest, lottery, or other promotion. In some cases, we may ask you specific questions to find out your preferences or to get your feedback on our company, products, services, and programs. We use this information to administer the promotion, including communicating with winners and announcing the identity of winners (if applicable), to improve our business, products, services, and programs, and for marketing initiatives, such as offers or promotions relating to Omega Park and its accommodations, products, services or programs, which we believe may be of interest to you, based on your marketing preferences.

> (e) We collect your Personal Information when you call our call centre, or when we call you

We could record incoming and outgoing calls from our call centres for accurate record keeping, quality assurance and training. We will retain the recordings of calls for as long as reasonably necessary for those purposes.

> (f) We collect your Personal Information from third parties

If you live in the United States, we may also supplement the Personal Information you provide to us with information we obtain from third parties.

INFORMATION WE COLLECT THROUGH COOKIES OR OTHER TRACKING TECHNOLOGIES

When you visit one of our websites or use our App, your web browser sends us certain information depending on the browser you use and your security settings. This information may include your IP address, the name and version of the operating system you use, the name and version of the web browser you use, and other technical data. They can also let us know if you accessed our website from a computer or mobile device and when you open the emails we send you, the date, time and duration of your visit and your geolocation data. This data provided by your web browser facilitates the administration, transfer of traffic and verification of our system. It also allows us to better understand the unique characteristics of our guests, how they use our services, and what we can do to improve the user experience. We may use this information to provide you with products and services, and to compile aggregate statistics. This helps us improve your experience both online and at our stations.

We also use “cookies” to personalize your website experience by adapting content to align with your browsing habits. Cookies are small pieces of data that install themselves on your hard drive and provide us with information about your online browsing habits, including your connection and browsing history, The buttons you click and your personal preferences. Cookies also tell us which account a user is logged into on one of our websites and this information allows us to protect your information by ensuring that your personal preferences are only displayed when you are connected. If you tell the Parc Omega website to “remember me” or save your preferences, this information is stored through cookies. Some cookies are also required to support transaction functionality (for example, putting items in your cart).

We may collaborate with advertising networks (such as Google Ads and Facebook Ads) Who use cookies and similar technologies to track your use of our websites and other websites to provide advertising about products and services based on your alleged interests. This advertising may appear on our website(s) or on other websites. Some of the technologies used by our advertising networks use separate cookies or other tracking technologies that may be transmitted to your device when you visit our websites, use our Apps, or open emails from us. We may also allow the use of social media plug-ins, such as Facebook, Twitter, Instagram, and Pinterest. When you visit a page on our website or our applications that contains a social extension, your Internet browser sends information to this social extension and this extension sends content directly to your Internet browser that allows it to know that you have accessed a page from one of our websites or Applications. An invisible pixel is a tiny graphic file with a unique identifier that is embedded in the code of a web page. We use pixel tags to count visitors to our websites and to monitor traffic in and between our websites, to communicate with cookies, to understand how you access our sites and to improve site performance. Pixel tags help us measure the effectiveness of our content and other offerings.

You can choose to disable cookies by accessing the preferences menu in your web browser. If you disable cookies, we will still be able to track your browsing history during a particular visit to our websites. However, we will no longer be able to link you to the history of each of your visits, as you will be considered a new visitor every time you access one of our websites. Although pixel tags can no longer track your activity on our websites, it is possible that pixel tags can track your activity from your IP address. We may combine the Personal Information you provide to us, or that we collect, to better understand your needs, requirements, and personal preferences in order to improve our business, our products, services and programs and optimize the quality of your experience when you visit our resorts or when you deal with a team member, call centre representative, agent or other authorized third party.

We may also use this information to send you offers, invitations and promotions related to our resorts, products, services, or programs that we believe may be of interest to you. For example, we may monitor your business transactions or browsing habits on our websites or at our park, which may determine the types of special offers and personalized promotions we send you.

WHEN DO WE SHARE YOUR PERSONAL INFORMATION?

We will not sell your Personal Information for monetary value. However, we may provide your Personal Information to third parties in the following circumstances:

  • Suppliers – We may share your Personal Information with suppliers (including related companies acting in this capacity) that provide services on our behalf, such as payment card processing, call centre administration, web hosting, data management, identity verification (for example, to confirm your eligibility for special offers, such as discounts for military personnel), market analysis, marketing, advertising and contest administration, or your Personal Information may be collected on our behalf by such service providers.

For example, we may disclose your Personal Information to a third-party tour operator if you purchase a tour operator tour using one of our Park’s websites.

YOUR CONSENT

We collect, use and disclose your Personal Information as described in this Policy and with your consent, or as otherwise required or permitted by law. We may be required or authorized by law or regulation to collect, use, or disclose your Personal Information without your consent, for example to comply with a court order, to recover a debt you owe us or if an imminent threat to the health, safety or well-being of an individual.

Your consent may be explicit (e.g., verbally, in writing or electronically) or your consent may be reasonably inferred from something you do (for example, by using our websites, you consent to the collection, use and disclosure of your Personal Information as described in this Policy). In some cases, an authorized representative may consent on your behalf. In the case of a minor child, a parent or legal guardian may consent to our collection, use and disclosure of a minor’s Personal Information.

However, withdrawal of your consent may affect your experience and our ability to provide you with products or services, or to serve you quickly and correctly, whether online or through our service agents.

If you object to the collection, use and disclosure of your Personal Information online as described in this Policy, do not use our website or Application.

HOW TO MANAGE YOUR MARKETING PREFERENCES

If you no longer wish us to use your Personal Information for marketing purposes, including to send you promotional offers, you may contact us (see the “Contact Us” section below) and request to be removed from our distribution and contact lists. We may ask you for more information when necessary to properly identify you.

You can also manage your email subscriptions by clicking on “Unsubscribe” to stop receiving promotional communications from us or by clicking on the “Manage your email preferences” link, which you will find at the bottom of each email you receive, to manage your email subscriptions.

If you no longer wish to receive SMS messages from us, please either reply “STOP” to the SMS, or contact the reception of the institution concerned, or contact us to make a request (see the “Contact us” section below).

Children under 13 years of age: We do not deliberately collect Personal Information from children under 13 years of age without the prior consent of a parent or legal guardian of the child. The Parc Omega website and social media pages available online are not intended for users under the age of thirteen. If you believe that your child under the age of 13 has been able to provide us with Personal Information online, please contact us at [email protected] and we will take appropriate action.

We require the consent of the child’s parent or guardian so that the child under 13 can open an account or create a profile on an application. Parents and guardians understand that the App may collect information about their child, such as photos, chat sessions, location information and the lifts the child used. We collect this information for the limited purpose of providing the Application Services. We do not collect and use this information to market products or services to children, and we will not sell its information. HOW DO WE PROTECT YOUR PERSONAL INFORMATION?

We generally keep your Personal Information on our records for a reasonable period of time that is sufficient to meet our needs described herein and, if applicable, the needs of the parties to whom we disclose it. This record will be stored on our servers or those of our service providers and will be accessible by our employees, service providers and authorized representatives. We maintain reasonable and systematic controls, schedules and practices for the retention and destruction of Personal Information.

Internal protections: We protect the integrity of your Personal Information through security mechanisms that are sensitive to the confidentiality of the information. We have policies and practices to protect against loss, theft, unauthorized access, disclosure, copying, use, modification or destruction. While we make efforts to protect your Personal Information, we are unable to guarantee that your Personal Information will always be secure. Factors beyond our control may result in the loss, theft, unauthorized access, use or disclosure of your Personal Information. As a result, we do not make any warranties or representations regarding the non-disclosure of your Personal Information. External protections: In order to protect information disclosed to service providers, we use contractual and other means to provide a similar level of protection so that service providers treat the information confidentially, implement appropriate security measures and only use and disclose information for the purpose of providing the services concerned.

Please be aware that your Personal Information may be transferred to, stored, and processed by us and our partner companies in Canada, the European Union and the United States where Parc Omega Inc., its partner companies or service providers carry out their activities and store data. Outside of Canada, your Personal Information may be subject to applicable foreign laws, which may authorize, in certain circumstances, a foreign government, Regulatory or national security authorities to access your Personal Information. By providing us with your Personal Information, you understand that your information may be transferred to our facilities and to third party service providers with whom we share it in accordance with the terms of this Policy.

ACCESS AND CORRECTION
