Parc Omega Inc. is committed to respecting the privacy of its customers and guests (“you” and “your”). Parc Omega Inc’s Privacy Policy (the “Policy”) applies to personal information that Parc Omega Inc collects online, in person, through its call centers or otherwise.
Personal Information” is information associated with an identifiable individual or household. Personal Information does not include company information or aggregated anonymous information that cannot be associated with a specific individual.
This Policy does not apply to information relating to employees of Parc Omega Inc. or to information other than personal information.
THE PERSONAL INFORMATION WE COLLECT AND HOW IT IS USED
Parc Omega Inc. collects Personal Information in the course of conducting its resort business. We use this information to provide you with the highest possible quality of service and to meet reasonable business needs.
>(a) We collect your Personal Information when you purchase an admission ticket or book accommodation.
When you purchase a product or service, make a reservation or register for a program, we collect Personal Information to complete the transaction and administer the purchase or program. We may also send you information related to your purchase, reservation or program. For example, if you make a reservation at one of our resorts, we may send you information about activities, events or offers taking place at the resort during your visit. The information we may collect and use for these purposes includes, but is not limited to:
- your name and contact details to identify and communicate with you;
- your payment card information to process transactions related to the purchase of park access tickets or accommodation reservations;
- your age and/or date of birth to ensure appropriate product pricing and to learn more about the people who benefit from our products and services;
- your gender to verify your identity, provide appropriate services such as equipment rental, and learn more about the people who take advantage of our products and services.
- information of a medical nature, such as allergies or a medical condition we need to know about if you have dietary restrictions
- your status as parent or guardian of a minor guest, if applicable;
- your experience preferences (such as the type of room you prefer);
- your geographic location in order to locate ski school participants or other guests who have chosen to use mountain tracking technology, including our Applications that offer such tracking, during their stay on our mountains;
- your transaction history to manage your purchases and reservations and to learn more about how you interact with our products.
- In some cases, you may provide us with Personal Information about a family member or another individual. When you provide us with Personal Information about someone other than yourself, you represent that you have that person’s consent to disclose his or her Personal Information for the purposes described in this Policy.
> (b) We collect your Personal Information when you visit our park, book accommodations, use our tickets, and download and use our web and mobile applications (the “Applications”).
When you purchase or use our Omega Park access tickets, we may collect information about your geographic location, activities and purchases made while at Omega Park. Our tickets use hand scanner technology. By using this technology, we may be able to collect limited information about your location within the center and, if a payment card is associated with your ticket, other commercial transactions you make in one of our stores, accommodations or restaurants. We use this information to understand how our guests use our centers and to understand your personal preferences.
Depending on your marketing preferences, we may also use your Personal Information to send you offers, invitations and promotions about our centers, products, services or programs that we think may be of interest to you. For example, we may monitor your business transactions or browsing patterns on our Web sites or at our centers, which may determine the types of special offers and personalized promotions we send you.
In addition, if you book accommodation, this privacy policy will apply to that transaction.
We also have an App that can be downloaded to your mobile device. Downloading, installing and using our App will give you convenient access to the wonderful experiences offered by our Nature Park, including the ability to purchase tickets and book accommodations, track and share your performance, create a profile, and receive notifications within the App (collectively, the “App Services”). If you access our Application, we may be able to collect your Personal Information, including your geographic location, activities and purchase history. We may also associate information collected as a result of your use of the Application with your customer profile, including ticket and/or accommodation data.
The Applications automatically collect detailed location and navigation information in the form of GPS signals from the mobile device on which you have installed and activated the Application (“Application Location Information”). When you open, use or interact with the Application Services, we use the Application Location Information (e.g., latitude and longitude) to customize the Application Services experience based on your current location. We also use your Application Location Information to provide you with certain Application Services, including to send you notifications of other relevant information. If “background location” is enabled, Applications may, from time to time, tell us the location of your device, even if you do not interact directly with the Application. We may use various technologies to determine your location information from the Application, such as the location services of the operating system in question, GPS, Bluetooth, i-Beacon, RFID and sensor data from your devices, in addition to nearby Wi-Fi access points and cell phone towers, and other technologies to determine the approximate location of your mobile devices.
If you do not want the Applications to track your Location Information, you must disable the Application’s Location Information tracking feature in the Application’s settings menu. If you deactivate the Application’s Location Information function, some of the functions of the Application and the Application’s Services cannot be provided without the use of this standard technology.
We record and store archives of this data on servers to provide these functions, in addition to protecting our rights and property with respect to our Application Services, and you acknowledge and agree to the storage of this data.
Some of our resorts may use video surveillance systems to ensure the safety of our guests, our employees and our facility. We will retain video recordings for as long as is reasonably necessary for these purposes.
> (c) We collect your personal information when you submit an inquiry, respond to a guest survey or provide feedback.
We may collect your name, contact information, comments or questions when you submit a request or comment, or when you otherwise provide us with feedback about our business. We may also collect information about your experience at one of our mountain destinations or your use of our products or services as part of a customer satisfaction survey. These surveys may include optional questions about your income, or gender which, if answered, help us learn more about our customers and how we can improve our business and public engagement in snowsports. We may use this information to answer your question and to improve our business, products, services and programs.
> (d) We collect your personal information when you participate in a marketing initiative or create an online account.
If you choose to create an online profile, we may collect your name, contact information, age, gender, date of birth, personal image, username and password, and any other information you choose to disclose to us (such as your preferences).
We may also collect your name, contact information and age or date of birth if you decide to participate in a marketing initiative such as a contest, sweepstakes or other promotion. In some cases, we may ask you specific questions to determine your preferences or to obtain your feedback on our company, products, services and programs. We use this information to administer the promotion, including contacting winners and announcing the identity of winners (if applicable), to improve our business, products, services and programs, and for marketing initiatives, such as offers or promotions relating to Omega Park and its accommodations, products, services or programs, that we think may be of interest to you, based on your marketing preferences.
> (e) We collect your Personal Information when you call our call center or when we call you.
We may record incoming and outgoing calls to our call centers for the purposes of accurate record keeping, quality assurance and training. We will retain call recordings for as long as is reasonably necessary for these purposes.
> (f) We collect your Personal Information from third parties
If you live in the United States, we may also supplement the Personal Information you provide to us with information we obtain from third parties.
INFORMATION WE COLLECT USING COOKIES OR OTHER TRACKING TECHNOLOGIES
When you visit one of our Web sites or use our Application, your Web browser sends us certain information depending on the browser you are using and your security settings. This information may include your IP address, the name and version of the operating system you are using, the name and version of the Web browser you are using and other technical data. It may also tell us whether you have accessed our website from a computer or mobile device, when you open e-mails from us, the date, time and duration of your visit and your geolocation data. This data, provided by your web browser, facilitates the administration, transfer of traffic and verification of our system. It also enables us to better understand the characteristics of our guests, how they use our services and what we can do to improve the user experience. We may use this information to offer you products and services, and to compile aggregate statistics. This helps us improve your experience both online and at our resorts.
We also use “cookies” to personalize your Web site experience by tailoring content to match your browsing habits. Cookies are small pieces of data that install themselves on your hard drive and transmit information about your online browsing habits, including your connection and browsing history, the buttons you click and your personal preferences. Cookies also tell us the account through which a user is connected to one of our Web sites, and this information allows us to protect your information by ensuring that your personal preferences are displayed only when you are actually logged in. If you tell the Parc Omega Web site to “remember me” or save your preferences, this information is stored using cookies. Some cookies are also necessary to support transaction functionality (for example, placing items in your shopping cart).
We may work with advertising networks (such as Google AdWords and Facebook Ads) that use cookies and similar technologies to track your use of our website(s) and other websites so that they can provide advertising about products and services based on your presumed interests. This advertising may appear on our website(s) or on other websites. Some of the technologies used by our advertising networks use separate cookies or other tracking technologies that may be transmitted to your device when you visit our websites, use our Applications or open e-mails from us. These advertising technologies are governed by the privacy policies of external advertising networks, and you must contact them directly to be removed from their list. Please contact us for this information. Several of the external advertising networks may be members of the Network Advertising Initiative (NAI). If they are, you have the option of opting out. We may also use services such as Google, Adobe Analytics and Facebook, which also use cookies and similar technologies, to provide us with information about how you use the content on our websites. For example, the content of the web page you clicked on, the length of your visit to our website and the website you visited before ours.
We may also enable the use of social media plug-ins, such as Facebook, Twitter, Instagram and Pinterest. When you visit a page on our website or Applications that contains a social extension, your Internet browser sends information to that social extension and that extension sends content directly to your Internet browser that lets it know that you have accessed a page on one of our websites or Applications. A web beacon is a tiny graphic file with a unique identifier that is embedded in the code of a web page. We use Web beacons to count visitors to our Web sites, to monitor traffic patterns within and between our Web sites, to communicate with cookies, to understand how you access our sites and to improve site performance. Web beacons help us measure the effectiveness of our content and other offerings.
You can choose to disable cookies by accessing your web browser’s preferences menu. If you disable cookies, we will still be able to track your browsing history during a given visit to our Web sites. However, we will no longer be able to link you to the history of each of your visits, as you will be considered a new visitor each time you access one of our Web sites. Although web beacons will no longer be able to track your activity on our websites, it is possible that web beacons will be able to track your activity based on your IP address. Please note that if you disable cookies, you may also disable certain features of the website that could affect its operation.
In order to better understand your interaction with our websites across multiple devices and to effectively deliver personalized promotions to you, we participate in the _“Adobe Marketing Cloud Device Co-op”_ program. WHEN DO WE COMBINE YOUR PERSONAL INFORMATION?
We may combine the Personal Information you provide to us, or that we collect from you, to better understand your needs, requirements and personal preferences in order to improve our business, products, services and programs and to optimize the quality of your experience when you visit our resorts or deal with a team member, call center representative, agent or other authorized third party.
We may also use this information to send you offers, invitations and promotions about our resorts, products, services or programs that we think may be of interest to you. For example, we may monitor your business transactions or browsing patterns on our Web site or at our Park, which may determine the types of special offers and customized promotions we send you.
WHEN DO WE SHARE YOUR PERSONAL INFORMATION?
We will not sell your Personal Information for monetary value. We may, however, provide your Personal Information to third parties in the following circumstances:
- Suppliers – We may share your Personal Information with suppliers (including related companies acting in this capacity) who perform services on our behalf, such as payment card processing, call center administration, website hosting, data management, identity verification (for example, to confirm your eligibility for special offers), market analysis, marketing, advertising and contest administration, or your Personal Information may be collected on our behalf by such service providers.
- Partners – We may disclose your Personal Information to third-party partners in situations that require such disclosure to perform or provide a service, product or information that you have purchased or requested. For example, we may disclose your Personal Information to a third-party tour operator if you purchase a tour from the third-party tour operator using one of our Park websites.
- Corporate Transactions – We may disclose your Personal Information to another entity, if necessary, in the event of an actual or proposed merger, sale, reorganization, including insolvency or bankruptcy, or for the purpose of evaluating or completing such transaction.
- Special Circumstances – We may deem it necessary or be required by law to disclose your Personal Information to our attorneys or to legally authorized third parties in certain emergency situations where the health, safety or welfare of an individual is imminently threatened, or if necessary to comply with a court order, or as otherwise required by law.
YOUR CONSENT
We collect, use and disclose your Personal Information as described in this Policy and with your consent, or as otherwise required or permitted by law. We may be required or permitted by law or regulation to collect, use or disclose your Personal Information without your consent, for example, to comply with a court order, to collect a debt you owe us or if there is an imminent threat to the health, safety or welfare of an individual.
Your consent may be express (expressed for example verbally, in writing or electronically) or your consent may be reasonably inferred from something you do (for example, by using our websites, you consent to the collection, use and disclosure of your Personal Information as described in this Policy). In some cases, an authorized representative may consent on your behalf. In the case of a minor child, a parent or legal guardian may consent to our collection, use and disclosure of a minor’s Personal Information.
Subject to certain legal or contractual restrictions, you may withdraw your consent at any time by contacting us at the locations indicated in the Access section of this Policy. However, withdrawing your consent may affect your experience and our ability to provide you with products or services, or to serve you promptly and accurately whether online or through our service agents.
If you object to the collection, use and disclosure of your Personal Information online as described in this Policy, do not use our Website or Application.
HOW TO MANAGE YOUR MARKETING PREFERENCES
If you no longer wish us to use your Personal Information for marketing purposes, including sending you promotional offers, you may contact us (see “Contact Us” below) and request to be removed from our mailing and contact lists. We may ask you for more information where necessary to properly identify you.
You can also manage your e-mail subscriptions by clicking on “Unsubscribe” to stop receiving promotional communications from us or by clicking on the “Manage your e-mail preferences” link, which you will find at the bottom of each e-mail you receive, to manage your e-mail subscriptions.
If you no longer wish to receive SMS messages from us, please either reply “STOP” to the SMS message, contact the reception of the establishment concerned, or contact us to make a request (see “Contact us” below).
Children under the age of 13: We do not knowingly collect Personal Information from children under the age of thirteen without first obtaining the consent of the child’s parent or legal guardian. The Parc Omega website and social media pages accessible online are not intended for users under the age of thirteen. If you believe that your child under the age of thirteen may have provided us with Personal Information online, please contact us at [email protected] and we will take appropriate action.
We require the consent of a child’s parent or guardian in order for a child under the age of 13 to open an account or create a profile on an Application. Parents and guardians understand that the Application may collect information about their child, such as photos, chat sessions, location information and lifts used by the child. We collect this information for the limited purpose of providing the Application Services. We do not collect or use this information to market products or services to children, and we will not sell this information. To deactivate your child’s account, request a copy of the information or ask a question about the Application and your child’s data, parents and guardians should contact our Privacy Officer at [email protected].
HOW DO WE PROTECT YOUR PERSONAL INFORMATION?
We generally keep your Personal Information on file for a reasonable period of time sufficient to meet our needs as described herein and, where applicable, the needs of the parties to whom we disclose it. This record will be kept on our servers or those of our service providers and will be accessible by our employees, service providers and authorized representatives. We maintain reasonable and systematic controls, schedules and practices for the retention and destruction of Personal Information.
Internal Safeguards: We protect the integrity of your Personal Information with security safeguards appropriate to the sensitivity of the information. We have policies and practices to protect against loss, theft, unauthorized access, disclosure, copying, use, modification or destruction. While we strive to protect your Personal Information, we cannot guarantee that your Personal Information will always be secure. Factors beyond our control may cause the loss, theft, unauthorized access, use or disclosure of your Personal Information. Accordingly, we make no warranties or representations as to the non-disclosure of your Personal Information. We also employ a Privacy Officer who is accountable for our compliance with these policies and whom you may contact at the address below if you have any questions or concerns, or if you wish to make a complaint.
External Safeguards: To protect information disclosed to service providers, we use contractual and other means to provide a similar level of protection so that service providers treat the information as confidential, implement appropriate security measures and use and disclose the information only for the purposes of providing the relevant services.
Please be aware that your Personal Information may be transferred to, and stored and processed by us and our partner companies in Canada, the European Union and the United States where Parc Omega Inc., its partner companies or service providers conduct business and maintain data. Outside Canada, your Personal Information may be subject to applicable foreign laws, which may permit, in certain circumstances, a foreign government, regulatory authorities or national security authorities to access your Personal Information. By providing us with your Personal Information, you understand that your information may be transferred to our facilities and to third-party service providers with whom we share it in accordance with the terms of this Policy.
ACCESS AND CORRECTION
Request a copy: To obtain free or low-cost access to, or a copy of, the Personal Information we have on file, send an e-mail to [email protected], to the attention of the Privacy Officer. Access to this information may be denied if you fail to demonstrate that you are the subject of the request. We may also have to withhold information if your access to it could threaten the life or security of an individual, reveal the Personal Information of a third party, breach confidentiality, violate solicitor-client privilege, disrupt a formal dispute resolution process or interfere with law enforcement.
Accuracy: We strive to ensure that your Personal Information is as accurate, complete and up-to-date as is necessary for the purposes for which it will be used or shared. In addition to your rights specified in this Policy, California citizens and households may request deletion or access to their Personal Information in accordance with the CCPA. To submit a deletion request or a request for access to your Personal Information, please contact our Privacy Officer at [email protected] or visit the “Contact Us” page of our website to submit a web form. You must include sufficient details in your request, such as your first and last name, date of birth, e-mail and postal addresses. We may ask for more information where necessary to correctly identify you. We will try to provide you with the required information within forty-five (45) days of receiving your request. We do not discriminate against customers who submit requests to access or delete their Personal Information.

Pursuant to California Civil Code Section 1798.83, California citizens may request certain information regarding disclosures we have made during the previous calendar year, if any, of their personal information to third parties for their own direct marketing purposes. To make such a request, please contact us at the above address. You must include sufficient details in your request, such as your first and last name, date of birth, e-mail and mailing addresses. We will attempt to provide you with the required information within thirty (30) days of receipt of your request. We reserve the right not to respond to requests sent more than once during a calendar year, or to requests submitted to an address other than that indicated in this policy.
European Union customers :
The Regulation on the Protection of Personal Data(RGPD) applies to users who are nationals or residents of one of the member states of the European Union. The rights of these persons in addition to the provisions of this privacy policy are protected by the RGPD and Parc Omega undertakes to comply with all the provisions laid down by the RGPD in the processing of personal data, in the rights of access, rectification, deletion and data of the persons concerned.
MODIFICATIONS
