(hereinafter the &#8220;Seller&#8221;). <\/p>\n<p>The General Terms and Conditions govern all sales of services made by telephone to the contact center, at the Parc Om\u00e9ga ticket office, at the vendor&#8217;s accommodation reception desk or online on the Parc Om\u00e9ga website www.parcomega.ca (the &#8220;Website&#8221;).<\/p>\n<p>The Vendor offers customers (i) hotel services in the form of stays or overnight stays (ii) services for visiting the animal park in the form of tickets (electronic ticket, annual subscription, gift certificate, combined ticket) and (iii) any other ancillary services (catering, etc.).   <\/p>\n<p>For the purposes of these terms and conditions : stay&#8221; refers to a tourist package, consisting of at least one overnight stay in one of the seller&#8217;s accommodations, a breakfast and a visit to Parc Om\u00e9ga; &#8220;accommodation&#8221; refers to a single night&#8217;s stay in one of the seller&#8217;s accommodations; &#8220;ticket&#8221; or &#8220;ticket&#8221; refers to a pass, day ticket, package or subscription allowing the customer to access Parc Omega&#8217;s leisure areas on a specific date or during a specific period; any purchase of one of the above-mentioned services implies the customer&#8217;s unreserved acceptance of the GTS, notwithstanding any stipulation to the contrary.<\/p>\n<h6><strong>Article 2: Seller identification<\/strong><\/h6>\n<p>The services described herein are organized and sold to customers by : Parc Omega INC.<\/p>\n<h6><strong>Article 3: Ordering services<\/strong><\/h6>\n<p>The purchase of services (hereinafter referred to as the &#8220;order&#8221;) is carried out :<\/p>\n<ul>\n<li>At the Vendor&#8217;s counter, 399 Route 323 Nord, Montebello, Qu\u00e9bec J0V 1L0, on Parc Omega opening days, and at the accommodation reception desk;<\/li>\n<li>By calling our contact center at 819 423-5487 (toll-free &#8211; cost of a local call);<\/li>\n<li>Online at <a href=\"https:\/\/www.parcomega.ca\/en\/\">www.parcomega.ca.<\/a><\/li>\n<\/ul>\n<p><strong>Article 3.1: Pre-contractual information<\/strong><\/p>\n<p>It is specified that the information appearing on the website and the booking summary, supplemented by the present GTC, constitute prior information. Consequently, the customer acknowledges having received communication, prior to confirmation of the reservation and conclusion of the contract, in a clear and comprehensible manner, of the pre-contractual information and in particular the following information: <\/p>\n<ul>\n<li>The destination, essential features and tourist category of the accommodation;<\/li>\n<li>Total price of the trip and payment terms ;<\/li>\n<li>Cancellation conditions;<\/li>\n<li>Services and meals included in the price of the activity;<\/li>\n<\/ul>\n<p>For all purchases of services other than stays, the customer acknowledges having received, prior to confirmation of the reservation and conclusion of the contract, clear and comprehensible communication of the pre-contractual information and in particular the following information:<\/p>\n<ul>\n<li>Description and essential features of the service;<\/li>\n<li>Price and execution date.<\/li>\n<\/ul>\n<p><strong>Article 3.2: Ordering by telephone<\/strong><\/p>\n<p>For orders placed by telephone, the customer must specify the delivery address (postal or e-mail) and the name of the beneficiary, in addition to the above-mentioned mandatory information.<\/p>\n<p>After having communicated to the customer the pre-contractual information listed in article 3.1 of the present GTC, the seller invites the customer to consult the present GTC. Once the customer has agreed to place the order in accordance with the terms and conditions communicated, the customer proceeds with remote payment in accordance with the terms and conditions set out in article 5. <\/p>\n<p><strong>Article 3.3: Online ordering<\/strong><\/p>\n<p>For all online orders, customers are asked to enter their e-mail address and, if necessary, to identify themselves by means of a form for creating a personal customer account. The customer has the opportunity to check the details of his order and its total price, and if necessary to correct any errors before confirming it, thereby expressing his acceptance. To finalize the order, the customer must read the terms and conditions, accept them by ticking the appropriate boxes and proceed to payment.  <\/p>\n<p><strong>Article 3.4: Order confirmation<\/strong><\/p>\n<p>The order is firm and definitive only when the full price has been received by the seller. The sales contract is then deemed to have been formed. For all orders for online or remote services, the customer receives, by e-mail, an order confirmation summarizing the purchases made, the price applied and the essential characteristics of the services ordered. For all Ticket orders, the confirmation e-mail includes :   <\/p>\n<ul>\n<li>Proof of payment ;<\/li>\n<li>Dematerialized access ticket(s).<\/li>\n<\/ul>\n<p>For all stay or accommodation orders, the confirmation e-mail includes :<\/p>\n<ul>\n<li>Proof of payment ;<\/li>\n<li>A description of the services ordered.<\/li>\n<\/ul>\n<p>The order confirmation e-mail received by the customer is proof of the entire transaction and constitutes the only authentic document in the event of a dispute.<\/p>\n<h6><strong>Article 4: Price of services<\/strong><\/h6>\n<p>Product prices are quoted in Canadian dollars, plus applicable taxes. All orders, regardless of origin, are payable in Canadian dollars. <strong>The seller reserves the right to modify its prices at any time<\/strong>. Products are always invoiced on the basis of the rates in effect at the time the order is placed.  <\/p>\n<p>The seller reserves the right to reduce fares and apply discounts at any time, without being obliged to refund customers who have purchased tickets at the regular price.<\/p>\n<p>Seller reserves the right, without further notice, to refuse to do business with any customer or to set a quantity limit on any item in an order. At any time, it may be necessary for Seller to verify personal or credit card information before accepting any order. <\/p>\n<p>The seller is subject to sales taxes applicable in Canada. Taxes added will be Q.S.T. (Quebec Sales Tax) and G.S.T. (Goods and Services Tax). <\/p>\n<h6><strong>Article 5: Terms and means of payment<\/strong><\/h6>\n<p>For all orders for services, the full price must be paid in Canadian dollars at the time the order is placed. Payment can be made by credit card, Mastercard or Visa. Proposed fees must be paid in accordance with the payment procedure described during the registration process. The Customer agrees to pay the total cost and charges of the product purchased, including taxes. The seller may modify the price after notifying the customer. The customer is solely responsible for the actual payment of the purchased product. The user alone is responsible for payment by credit card for the service offered. The seller is not responsible for payment problems related to the operation of the e-commerce service.       <\/p>\n<p>Electronic payments made in the context of telephone orders or online orders on the seller&#8217;s website are secured by the use of an encryption process guaranteeing the confidentiality and security of data.<\/p>\n<h6><strong>Article 6: Delivery of tickets and terms and conditions<\/strong><\/h6>\n<p>For all remote orders, access tickets are sent to the customer by e-mail immediately after payment of the order.<\/p>\n<p><strong>Day tickets<\/strong><\/p>\n<p>Non-refundable product. The customer confirms that he\/she has read and understood the safety instructions and any other special measures put in place by the seller (see Articles 9 and 11). <\/p>\n<p><strong>Oniro tickets or night event<\/strong><\/p>\n<p>Non-refundable and non-changeable product (date and time).<\/p>\n<p>Rain or shine, the event takes place. In the event of adverse weather conditions (tornado or severe thunderstorm), the vendor may delay departures or cancel the activity to ensure everyone&#8217;s safety. In the event of cancellation, information will be posted the same day at 3 p.m. on parcomega.ca, as well as on the Park&#8217;s Facebook page. In the event of cancellation by the vendor, ticket holders will be able to select a new date and time slot.   <\/p>\n<p>Reservations required for toddlers (2-5 years). Children 12 and under must be accompanied by an adult at all times. Drugs and alcohol are strictly forbidden during this activity.  <\/p>\n<p>By purchasing a ticket, customers acknowledge that they are using the trail at their own risk. The trail is not recommended for people with reduced mobility, and includes ascents and descents of around 35 degrees. By purchasing a ticket, the customer acknowledges that he\/she is able to undertake the activity with full knowledge of the facts and accepts the risks involved. The customer undertakes to comply with all safety and other regulations imposed by the vendor.   <\/p>\n<p><strong>Gift certificate<\/strong><\/p>\n<p>This product is non-refundable and non-cashable. Resale is strictly forbidden and illegal. The amount of the gift card can be used on the purchase of entrance fees, on the catering and in the various points of sale of Parc Om\u00e9ga. The gift certificate is not valid for online booking or payment. It is not replaceable or refundable in the event of loss, theft or damage.    <\/p>\n<p><strong>Annual membership<\/strong><\/p>\n<p>This product is non-refundable and non-exchangeable.<\/p>\n<p>The season pass issued by the vendor gives holders access to the animal park at all times during current opening hours (opening hours vary by season).<\/p>\n<p>The subscription is valid for one year. The membership period begins on the date of purchase. Once the purchase has been made, the individual must come to Parc Om\u00e9ga to take his\/her photo and pick up his\/her card before his\/her first visit.  <\/p>\n<p>The membership can only be used by the holder and cannot be sold, transferred or exchanged at any time.<\/p>\n<p>The holder&#8217;s photo must appear on the season ticket.<\/p>\n<p>Season ticket holders under 16 years of age must be accompanied by an adult to gain access to the park.<\/p>\n<p>To gain access to the park, season ticket holders must present their season ticket at the entrance. An identity card may be requested from the season ticket holder at any time. <\/p>\n<p>In the event of broken or lost cards, a new card can be requested from the administrative office for a fee of $5.<\/p>\n<p>The vendor reserves the right to temporarily close the park or certain sections of the park due to extreme weather conditions or any other exceptional condition.<\/p>\n<p>The seller reserves the right to close parts of the park without notice.<\/p>\n<p>A membership card may be withdrawn at any time by the vendor if the customer&#8217;s behavior does not comply with safety regulations on the Parc Om\u00e9ga site. No refund or compensation will be given in such a situation. <\/p>\n<h6><strong>Article 7: Ticket control<\/strong><\/h6>\n<p>A dated ticket is valid only for the date(s) it specifies. An undated ticket does not guarantee access to the park during peak periods. Tickets are checked at the Parc Omega entrance using barcode or QR code readers. The vendor reserves the right to check the identity of ticket holders.   <\/p>\n<p>E-tickets are only valid if they are printed on blank, white paper on both sides, or if they are displayed on a Smartphone-type cell phone screen.<\/p>\n<p>The customer remains solely responsible for the use made of his\/her ticket(s). A ticket (thermal or dematerialized) that is damaged, has an illegible barcode or has already been read is considered invalid. <\/p>\n<p><strong>Article 8: Product descriptions<\/strong><br \/>The seller and its affiliates make every effort to ensure the utmost accuracy on the site. However, the seller does not warrant that product descriptions or other content of the parcomega.ca site are accurate, complete, reliable, current or error-free. If a product offered by the seller does not conform to its description, your only recourse is to contact the seller.  <\/p>\n<p><strong>Article 9: General safety rules<\/strong><\/p>\n<p>The customer confirms that he\/she has read and understood the safety instructions and any other special measures in place. A vehicle (car, bus, RV) is required to visit the park. Motorcycles are not permitted on site. Pets are strictly forbidden in the park and in Parc Om\u00e9ga accommodations. It is forbidden to leave the vehicle. All vehicle doors must be closed (tailgate and sliding doors). During the drive, windows must be half up to prevent animals from sticking their heads into the customer&#8217;s vehicle. It is forbidden to feed the bison. During the breeding season (September to mid-November), avoid approaching male deer. It is strictly forbidden to feed them. <strong>You drive at your own risk<\/strong>, and in the event of failure to comply with these general safety rules, the vendor cannot be held responsible, and reserves the right to exclude, without any refund being possible, customers who fail to comply with these general safety rules.         <\/p>\n<p><strong>Article 10: Recommendations<\/strong><\/p>\n<ul>\n<li>Bring photo ID and the credit card used to purchase your ticket with you on your visit.<\/li>\n<li>Protect your banknote like any other valuable item.<\/li>\n<li>Never buy an electronic ticket from a stranger. It may be an unauthorized copy. Electronic tickets have no resale value.  <\/li>\n<\/ul>\n<p><strong>Article 11: Liability<\/strong><\/p>\n<p>The e-ticket holder assumes all responsibility for risks and hazards that may arise from the activity whether incurred before, during or after the activity and waives all claims for loss and damage resulting from any cause whatsoever. The vendor cannot be held responsible for any direct or indirect problems or damages that may arise during the event. <\/p>\n<p>The electronic ticket, annual pass or gift certificate constitutes a contract between the customer and the seller. The purchaser agrees to pay the amount indicated on the receipt, including any service charges. The amount invoiced will appear on the next statement of account under the name of PARC OM\u00c9GA INC. No refunds or exchanges will be made unless the event is cancelled by the seller. In such a case, the buyer must contact the event promoter or PARC OM\u00c9GA INC. administration at (819) 423-5487.     <\/p>\n<p><strong>Article 12: Exceptional and unavoidable circumstances<\/strong><\/p>\n<p>Exceptional and unavoidable circumstances are defined as any situation beyond the control of the customer, the seller and any service provider involved in the execution of the order, the consequences of which could not have been avoided even if all reasonable measures had been taken, and which prevent the performance of all or part of the obligations under the contract.<\/p>\n<p>This will be the case in particular in the event of: force majeure, climatic, geographical, sanitary or political conditions in the immediate vicinity of the destination likely to endanger the customer&#8217;s life. In the event of the occurrence of exceptional and unavoidable circumstances, both the seller and the customer may cancel the contract at no cost.
